You MUST read this document before starting the procedure :

The purpose of the acknowledgment letter is to make it easier to obtain a Talent Passport/investor status (multi-year residence permit for a maximum of four years) for foreign investors wishing to invest and come to live in France.

First scenario : you are investing through a company

You must meet all the following conditions :

1. You are investing through a company which you manage personally or in which you own at least 30% of the capital ;
   
2. You plan to create or protect jobs within the four years following the investment in France ;
   
3. The investment in tangible or intangible fixed assets must represent at least €300,000.
   

Second scenario : you are investing personally

You must meet all the following conditions :

1. You are investing personally in a company in which you will acquire a long-term interest ;
   
2. You plan to create or protect jobs within the four years following the investment in France ;
   
3. The investment in tangible or intangible fixed assets must represent at least €300,000.
   

To access the “Démarches-Simplifiées” (streamlined procedures) website, you MUST enter the following personal information :

• First name – Surname ;
• Date of birth ;
• Place of residence ;
• Nationality ;
• Passport number ;
• Personal investment or investment through a company.

The process then has two stages :

Stage one :

You will provide us with a brief description (between 300 and 1,000 characters) of your investment project so that we can provide you with support in optimum conditions (project’s general goal, estimated investment amounts, targeted sectors).

Stage two :

You will have to attach the following documents to support your declaration :

• A copy of your passport (MANDATORY) ;
• Your curriculum vitae (MANDATORY) ;
• Investment track record (MANDATORY) ;
• A copy of a bank statement showing a minimum balance of €300,000 (MANDATORY) ;
• The letter of undertaking (fill in the model available in the website - MANDATORY) ;
• The company’s registration certificate (ONLY if you are making the investment through a company).

Potential penalties for false declarations :

When using the service, the user undertakes to provide only accurate, up-to-date and complete information. Should the user fail to comply with this obligation, the agency or partner administrative authority reserves the right to suspend or cancel his/her application, without prejudice to any potential legal proceedings.

It is hereby specified that that any false declaration made personally or on behalf of a third party makes the user liable to the sanctions set out in Article 441-1 of the French Penal Code which stipulates penalties of up to three years in prison and a fine of up to €45,000.

La lettre de reconnaissance délivrée vise à faciliter l’obtention d’un passeport talent / mention investisseur (carte de séjour pluriannuelle d’une durée maximale de 4 ans) aux investisseurs étrangers souhaitant investir et s’installer en France.

Premier cas : vous investissez via une entreprise

Vous devez remplir toutes les conditions suivantes :

1. Vous investissez via une entreprise que vous dirigez personnellement ou dans laquelle vous détenez au moins 30 % du capital ;
   
2. Vous envisagez de créer ou sauvegarder de l'emploi dans les 4 années qui suivent l'investissement en France ;
   
3. L’investissement en immobilisations corporelles ou incorporelles doit représenter au moins 300 000 €.
   

Deuxième cas : vous investissez personnellement

Vous devez remplir toutes les conditions suivantes :

1. Vous investissez personnellement dans une entreprise dans laquelle vous acquérez un intérêt durable ;
   
2. Vous envisagez de créer ou sauvegarder de l'emploi dans les 4 années qui suivent l'investissement en France ;
   
3. L’investissement en immobilisations corporelles ou incorporelles doit représenter au moins 300 000 €.
   

Pour accéder à la plateforme démarches-simplifiées, vous serez amenés à entrer des informations personnelles OBLIGATOIRES :

• Prénom - Nom ;
• Date de naissance ;
• Lieu de résidence ;
• Nationalité ;
• Numéro de passeport ;
• Investissement personnel ou par l’intermédiaire d’une entreprise.

La démarche comporte par la suite deux étapes :

Première étape :

Vous aurez à nous proposer un court texte descriptif (entre 300 et 1000 signes) de votre projet d’investissement afin que nous puissions vous accompagner dans les meilleures conditions (objectif général du projet, montants estimés d’investissement, secteurs ciblés).

Deuxième étape :

Vous serez amenés à ajouter les pièces justificatives listées ci-après, attestant votre déclaration :

• La copie du passeport (OBLIGATOIRE) ;
• Le curriculum vitae (OBLIGATOIRE) ;
• Le track record des investissements (OBLIGATOIRE) ;
• L’extraction de compte (minimum 300 000 € - OBLIGATOIRE) ;
• La lettre d’engagement (complétez le modèle proposé dans la plateforme - OBLIGATOIRE) ;
• Le certificat d’immatriculation de la société (UNIQUEMENT si vous investissez via une entreprise).

Risques encourus en cas de fausse déclaration :

L’usager s’engage à ne fournir, dans le cadre de l’utilisation du service, que des informations exactes, à jour et complètes. Dans l’hypothèse où l’usager ne s’acquitterait pas de cet engagement, l’opérateur ou l’autorité administrative partenaire se réservent le droit de suspendre ou supprimer sa demande, sans préjudice d’éventuelles poursuites judiciaires.

Il est rappelé que toute personne procédant à une fausse déclaration pour elle-même ou pour autrui s’expose, notamment, aux sanctions prévues à l’article 441-1 du code pénal, prévoyant des peines pouvant aller jusqu’à trois ans d’emprisonnement et 45 000 euros d’amende.
